The Court of Cassation expresses its opinion on Law 104 and the improper use of permits recognized by it.
In the ordinance no. 17102/2021 recognize the improper use of permits as an abuse of the law and violation of the principles of fairness towards the employer and the insurance body, especially in the event that activities are carried out during the use of the permits provided for by law 104. completely incompatible with those of assistance. The order therefore makes it legitimate for the employer to have recourse to an investigator to verify the unlawful conduct of employees during leave and, possibly, disciplinary dismissal.
